Terms of Service

1. Acceptance of Terms

By accessing or using Evensee ("Service"), operated by Evensee ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Evensee provides a transactional email API that automatically brands emails based on your domain. The Service includes email sending, template rendering, brand detection, verification tokens, and MCP integration for AI agents.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized use.

4. Plans and Billing

The Service offers free and paid plans. Paid plans are billed monthly and include a set number of email credits. Credits reset each billing period. When credits are exhausted, emails are sent via our standard SMTP delivery with Evensee branding. Paid plans use premium delivery with no branding.

You may cancel your subscription at any time. Your plan will remain active until the end of the current billing period. Refunds are not provided for partial periods.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited emails, or bulk marketing without recipient consent
  • Distribute malware, phishing, or fraudulent content
  • Violate any applicable laws or regulations (including CAN-SPAM, GDPR)
  • Impersonate another person or entity
  • Interfere with or disrupt the Service

We reserve the right to suspend or terminate accounts that violate these terms.

6. API Usage

API keys are personal and must not be shared publicly. Rate limits apply to all plans. We may throttle or block requests that exceed reasonable usage patterns or that could impact service quality for other users.

7. Intellectual Property

The Service, its design, code, and documentation are owned by Evensee. You retain ownership of your content and data. By using the Service, you grant us a limited license to process your data solely to provide the Service.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
